4. Market description
4.1 Data controller
Under the terms of the Personal Data Processing Policy, available on the Site, the companies belonging to the Enel Group incorporated in Colombia, as affiliates, subsidiaries, and companies economically linked to the Enel Group (companies that collectively and hereinafter will be referred to as the “Enel Group Companies in Colombia” and which are fully identified in Annex I of the Personal Data Processing Policy of the Enel Group Companies in Colombia) shall act as Data Controllers and will process personal data obtained through “cookies” provided via the Site in accordance with the applicable provisions established under Colombian privacy and personal data protection laws, particularly Act 1581 of 2012, Decree 1074 of 2015, the Personal Data Processing Policy of the Data Controller, and this Policy.
4.2 Definition of cookies
Cookies are small text files that websites send to users’ devices (for example, desktop computers, tablets, smartphones, laptops, etc.), where they are stored and later transmitted back to the same websites upon the user’s subsequent visit.
Cookies may require the user’s prior consent. Cookies make it possible to identify the device on which they are stored throughout their validity or registration period. During visits to the Site, information related to browsing data received from the user’s device may be stored in the cookies installed on that device.
Cookies serve different functions and make browsing the Website more efficient by remembering user preferences and improving the browsing experience. They may also help personalize advertisements displayed during browsing and marketing activities directed to the user, ensuring that they reflect the user’s interests and preferences.
Cookie settings may be modified at any time. The following information provides further details regarding the cookies used by the Website and the ways in which related settings can be managed.
4.3 Purposes and types of cookies used
When connecting to the Site through a browser, cookies may be installed on the user’s device in order to recognize the device used, ensure access to and use of the Site during the validity period of the cookies, and collect information regarding access to the Site itself.
While browsing the Site, the user may also receive cookies on their device that are sent from different websites or web servers (so-called “third parties”), which may contain certain elements (e.g., images, maps, sounds, specific links to pages on other domains) present on the site the user is visiting. Accordingly, within this category, the following may be identified:
- First-party cookies: sent directly from Enel to the user’s device.
- Third-party cookies: originating from a third party but sent on Enel’s behalf.
Depending on the purpose for which cookies are used, they may be classified as follows:
Technical cookies: Their use is strictly limited to the transmission of session identification data (random numbers generated by the server) necessary to enable secure and efficient browsing of the Site. They are not permanently stored on the user’s device and disappear when the browser is closed. The use of these cookies is aimed at ensuring security and improving the service offered to users. Analytical cookies that collect aggregated information about visits to the website and user navigation for the purpose of optimizing its content may be treated as technical cookies.
Analytical cookies: Enel uses analytical cookies to analyze the number of users and how they use the Site. When aggregated information is collected about visits to the site and user navigation, the analytical cookies used may be treated as technical cookies and do not require consent; therefore, they are included in the “technical cookies” category mentioned above. Otherwise, their use is permitted only with the user’s consent (for example, third-party analytical cookies that combine such data with other processing activities).
Behavioral advertising cookies: These cookies require the user’s consent. Behavioral advertising cookies create user profiles and are used to send advertising messages that reflect the preferences expressed by the user while browsing the web or to enhance the user’s browsing experience. These cookies may only be used for this purpose with the user’s consent. Behavioral advertising cookies may also include retargeting cookies, which allow the display of personalized advertisements based on the user’s interests and browsing behavior. These cookies enable partners to communicate, optimize, and serve advertisements based on the user’s browsing history.
4.4 Third-Party content on our website
GOOGLE RECAPTCHA
In order to protect the user’s personal data and ensure secure browsing on the Site, particularly for registration in individual restricted-access areas, Enel uses the Google reCAPTCHA service provided by Google LLC (“Google”). The processing of personal data for the aforementioned purpose is based on Enel’s legitimate interest in ensuring the security of the Site. Through Google reCAPTCHA, analyses can be conducted to determine whether data entry is carried out by a natural person or by an automated bot.
More information about Google reCAPTCHA can be found here.
YOUTUBE VIDEOS
The Enel website includes YouTube videos hosted at www.youtube.com and viewable directly from the Site. For this purpose, the youtube-nocookie.com domain is used on the Site, which prevents user tracking during video playback or, alternatively, requires the user to accept YouTube’s Terms and Conditions.
4.5 Management of cookies through the cookie consent management tool or browser settings
Users may select their cookie preferences by clicking the “Settings” button displayed in a banner upon first accessing the Site. Thereafter, users may modify their cookie preferences at any time through the link available on the Site.
Alternatively, if the user wishes to modify preferences through browser settings, below are the options offered by the main browsers that allow users to manage their choices regarding the use of cookies:
- Internet Explorer
- Chrome
- Firefox
- Opera
- Safari
If a mobile device is used, the user should consult the device’s instruction manual to learn how to manage cookies. Almost all internet browsers allow users to check which cookies are stored on their hard drive, block all cookies, or receive a notification each time a cookie is installed. However, in some cases, if a particular cookie is not installed, certain sections of the Site may not function properly.
4.6 Processing of personal data
For more information regarding the processing of users’ personal data, please refer to the Personal data processing policy available here.
