Description
Exemption of electric power consumption for billing purposes applicable to common areas.
REQUIREMENTS
1. The Legal Representative’s request for the exemption.
2. Certificate of existence and legal representation of the legal entity, as issued by the Municipal or District Mayoralty where the building or common areas are located, or the person or entity in whom this authority is delegated. It has to include the name of the legal representative and the date when common ownership was registered as horizontal property regime. Validity cannot be greater than 1 year.
3. Certificate signed by the Statutory Auditor under the parameters of Law 43 of 1990 and the regulations that regulate, modify or add to it, certifying:
- That no industrial and/or commercial activities are practiced in the common areas.
- That industrial and/or commercial activities do take place inside the Complex or Building and are directly executed by the Horizontal Property’s Management and that the income derived from said activities is exclusively destined to pay the common expenses that facilitate the existence of the horizontal property, its stability, operation, conservation, security, use, enjoyment or exploitation. The foregoing applies for Complexes or Buildings that have a Statutory Auditor either legally or voluntary.
4. The Complexes or Buildings that do not have a statuary auditor must present a certificate signed by the Legal Representative of the Legal Entity, certifying the conditions indicated in the previous numeral.
5. Inspection results that determine that within the common areas no commercial or industrial activities are carried out.
